2022 Disclaimer for Condo Questionnaire Addendum

Wind Drift Quiet Time Rules for Owners and Construction of Personal Units

  • No one shall make or permit to be made any noises that will disturb or annoy the occupants of any other units at Wind Drift.
  • No one shall permit anything to be done that will interfere with the rights, comfort or convenience, or safety of others.
  • Inappropriate behavior or conduct towards anyone will not be tolerated.
  • Light construction in units is permitted during standard business hours from 8 am to 5 pm Monday - Friday and on Saturday from 10 am – 4 pm.
  • No construction on Sunday.
  • Quiet time at Wind Drift is 10 pm to 8 am.
  • Unit owners invited guests and renters will be held responsible for the actions of minors occupying the unit and under their control at all times.

Rules:

  • A pass may not be reused
  • Dates of stay must be clearly marked on the pass and must reflect the dates of the renter or non-owner guest stay
  • The condo unit # must be clearly marked on the pass
  • A non-owner is anyone who is not on the property deed as recorded on the Baldwin County property records.
  • A time share guest that is not on the property deed as recorded on the Baldwin County property records is not an owner.  They are considered a type of renter.

Release of Liability 

Both of the above forms must be completed and returned with the required documentation to admin@wavesassocmgmt.com. 

*A fee of %3.85 will be added to the total for payments made by credit card. 

  • Renters/Non-Owner Guests - $50/day*
  • Renters/Non-Owner Guests - $300/week*(3/1 – 11/30)
  • Renters/Non-Owner Guests – Seasonal $200/month* (12/1 – 2/28)

Boatyard Storage/Dock Use for Owners:

 

  • Owner (on recorded property deed) boatyard storage- $500/year to reserve for the year (January 1 - December 31).
  • Owner (on recorded property deed) dock only - $300/year (January 1- December 31)

Violation of the Boat Registration or Guest Registration Rules:

  • First Warning - $100 fine chargeable to the owner’s account
  • Second Warning - $250 fine chargeable to the owner’s account
  • Third Warning - $500 fine chargeable to the owner’s account

A $200.00 Condo Questionnaire fee can be paid by check (mailed or overnight) or credit card (fee of $7.00). Once the payment is received, we will complete it within 72 business hours. *Please be advised that at this time, no addendums will be completed or questions answered about the structural integrity or deferred maintenance, etc. We reserve the right to refuse this portion of the questionnaire.  As you can imagine, the liability these questions place on the Association and Management Company is quite large since we are not experts in this field. If this is a part of your questionnaire, please note it will not be completed by Waves.

Please acknowledge the highlighted portion above before proceeding with payment- there will be no refunds. By submitting your payment, you acknowledge that you have read and understand that language.

32. Condominium Disclosures:

If the Property is a CONDOMINIUM, Seller shall obtain from the Condominium Owner's Association (as applicable) and deliver to the Buyer within ____ Business Days (5 Days if left blank) following the Acceptance Date of the Agreement to submit to Buyer the following information, including information available under Section 35-8A-409 (a) of the Alabama Uniform Condominium Act:

a. Recorded Declaration of Condominium and any amendments thereto, Bylaws, Covenants/Restrictions, Rules/Regulations.  SEE ABOVE IN BLUE- Click and reveal documents for download or sharing.

b. Minutes from the last 2 Annual Owners Meetings and the last 2 Board of Director's Meetings. Available to the owner, they must log in and email them to their agent.

c. A statement setting forth the amount of the monthly common expense assessment and any unpaid common expense or special assessment currently due and payable from the selling unit owners.  The owner will need to request a statement that will be sent to them directly and can be shared, showing their monthly fees and any outstanding debts.  

d. A statement of any other fees payable by unit owners. There are no other fees, however; upon closing, there is a $100.00 transfer fee made payable to Waves Association Management, 191 Northshore Circle, Gulf Shores, AL  36542 is required. 

e. The most recent regularly prepared balance sheet and income and expense statement, if any, of the association. Available to the owner, they must log in and email them to the agent.

f. The current operating budget of the association. Available to the owner, they must log in and email them to the agent.

g. A statement of any unsatisfied judgments against the association and any pending suit in which the association is a party. To our knowledge, there are no unsatisfied judgments against the association nor any pending suits in which the association is a party. There is a pending suit against the association for payment on a roof application which was before Hurricane Sally.  The association is the defendant of this claim. 

h. A statement describing any insurance coverage provided for the benefit of unit owners. Please contact Whitehaven Insurance at 251-967-3323

i. A statement of the remaining term of any leasehold estate affecting the condominium and the provisions governing any extension or renewal thereof. To my knowledge, there are no leasehold estates affecting the condominium. 

j. A statement of any restrictions in the declaration affecting the amount that may be received by a unit owner upon sale, condemnation, casualty loss to the unit or condominium, or on termination of the condominium.  If there are any restrictions, they are outlined in the Articles/Declarations, and owners are encouraged to review association documents for stated restrictions.

Buyer shall have 5 Business days, from receipt of disclosures to review and approve, or notify Seller in writing if not satisfactory, otherwise, this contingency shall be deemed removed.
